DWI Punishments

Texas’s laws against drunk driving have gradually increasing penalties for consecutive convictions. While being accused of drunk driving is several steps away from being convicted of drunk driving, it is still important to know what kinds of penalties you may be facing.

  • A first-time conviction is a Class B misdemeanor. Typical penalties include a fine of less than $2,000, up to six months in jail, and up to 100 hours of community service. Most people who are convicted of their first DWI are subject to a year or two of probation as well.
  • Second-time convictions are Class A misdemeanors and lead to even greater punishments. A second DWI conviction can cause a two year suspension of a person’s drivers license. Class A misdemeanors also come with fines of up to $4,000 and up to a year in prison.
  • A third DWI conviction is a third degree felony. This is punishable by at least two years imprisonment, fines not to exceed $10,000 and many other serious penalties that you will want to avoid.
