More Texas cities require blood test in DWI arrest

More cities and counties in Texas are using the ‘no refusal’ blood test policy in order to measure a person’s blood alcohol level while driving if they refuse a breathalyzer

This idea was only used in a few cities at first, but has now spread to an initiative that is now used in many places statewide. The policy is usually put into place during holiday weekends when heavy alcohol consumption is expected.

Although, the initiative is even spreading to other states, it is still rather controversial. Criminal defense lawyers across the state feel that it violates the rights of citizens and is an unreasonable search and seizure procedure.

During the July 4 holiday weekend, over 500 police agencies¬† statewide put the ‘no refusal’ policy into affect. Bexar County recently made the mandatory blood draw a permanent policy.
