Taking DNA samples is upheld by Supreme Court

The taking of DNA samples by police from people under arrest was considered legal by the Supreme Court on June 3 and was compared to modern day fingerprinting.

Five justices made the majority ruling that those arrested for a serious crime and detained in a police station can be given DNA testing. They further stated that the move does not violate an illegal search, which is prohibited by the Fourth Amendment.

Justice Samuel Alito said that this ruling was probably a milestone criminal procedure case that the court had decided upon in many years. He added that DNA sampling requires only a small intrusion on a person’s privacy.
