Texas Drug Penalty Groups

In order to establish penalties for the possession, manufacture, and sale of illegal drugs, the Texas Controlled Substances Act categorizes the substances it makes illegal into four “Penalty Groups.” These Penalty Groups each carry different standardized punishments, the most severe of which belong to Penalty Group 1. Penalty Group 4 has the least severe punishments, but a conviction of such a charge will still have considerable repercussions.

Penalty Groups

Each Penalty Group found in the Texas Controlled Substances Act contains certain illicit drugs and outlines the punishments for being found in possession of them. Examples from each penalty group include:

  • Penalty Group 1: opiates, cocaine, ketamine
  • Penalty Group 2: mescaline, MDMA, psilocybin
  • Penalty Group 3: hydrocodone, clonazepam, diazepam
  • Penalty Group 4: medicines that can be abused, such as codeine

There is a specific Penalty Group for LSD, Penalty Group 1-A. Being found to be in possession of even one “abuse unit” of LSD is a state jail felony. Subsequent Penalty Groups carry on with slightly decreasingly severe punishments.
